Terms of service
NBRC Online Catalogue – Terms of Use These Terms of Use (hereinafter referred to as the “Terms”) set forth the terms of use of the NBRC online catalogue (hereinafter referred to as the “Service”) provided by the Biological Resource Center, National Institute of Technology and Evaluation (NBRC) (hereinafter referred to as the “Organization”) on this website. Registered users (hereinafter referred to as the “Users”) are required to use the Service in accordance with the Terms. Article 1 (Application) 1. The Terms shall apply to all relationships related to the use of the Service between the Users and the Organization. 2. Regarding the Service, in addition to the Terms, the Organization may form various provisions (hereinafter referred to as the “Individual Provisions”) such as rules for use. Regardless of their name or title, these Individual Provisions shall form part of the Terms. Article 2 (Registration for use) The persons who wish to register for the Service shall agree to the Terms and apply for registration by the method set forth by the Organization, and when the Organization notifies such person who wish to register of the approval of application, the registration for use shall be completed. Article 3 (Management of user ID and password) 1. The Users shall manage the user ID and the password of the Service at their own responsibility. 2. The Users shall neither transfer or loan the user ID and the password with a third party, nor share them with a third party under any circumstances. 3. The Organization shall not have any responsibility whatsoever for any damage caused by insufficient management of the user ID or the password, their incorrect use, or use by a third party, and the like. Article 4 (Sale and purchase agreement) 1. In the Service, the sale and purchase agreement shall conclude when the Users make an application for purchase with the Organization and the Organization notifies that the application has been accepted. Regarding the Biological Material to be purchased and sold, the Users shall follow the provisions of the “ Terms and Conditions”. 2. The payment method, delivery method, cancellation method of purchase application, return method, etc. related to the Service will be determined separately by the Organization. Article 5 (Attribution of rights) The copyrights or patent rights of photographs, other contents, and other intellectual property rights of Biological Material provided through the Service (hereinafter referred to as the “Contents”), shall be attributed to the legitimate holders such as the Organization and the content providers, and the Users may not copy, reprint, modify, or otherwise use them for secondary purposes without permission. Article 6 (Prohibited matters) The Users shall not commit in the following acts when using the Service. 1. Acts that violate laws and regulations or public order and morals 2. Acts related to criminal activities 3. Acts that infringe copyrights, trademark rights and other intellectual property rights included in the Service 4. Acts that would destroy or interfere with the functions of the Organization's servers or its networks 5. Acts of commercially using the information obtained by the Service 6. Acts that may interfere with the operation of the Organization's services 7. Acts of unauthorized access or attempting the same 8. Act of collecting or accumulating personal information about other users 9. Act of pretending to be another user 10. Acts of using the Service for improper purposes 11. Acts that directly or indirectly benefit antisocial forces in relation with the Organization's services 12. Other acts that the Organization deems inappropriate Article 7 (Suspension of provision of the Service and the like) 1. The Organization may suspend or interrupt the provision of all or part of the Service without prior notice to the Users if it determines that any of the following reasons is present. 1. When doing maintenance, inspection or upgrade of the computer systems related to the Service 2. When it becomes difficult to provide the Service due to force majeure events such as earthquake, lightning strike, fire, power outage, or natural disaster 3. When the computer or communication line etc. stops due to an accident 4. In addition, when the Organization determines that it is difficult or inappropriate to provide the Service 2. The Organization shall not have any responsibility whatsoever for any disadvantage or damage suffered by the Users or a third party due to the suspension or interruption of the provision of the Service. Article 8 (Restrictions of use and deletion of registration) 1. In any of the following cases, the Organization may restrict the use of all or part of the Service to the Users or cancel the registration as the Users without any prior notice. 1. When any of the provisions of the Terms is violated 2. When it is found that there is a false fact in the registration matters 3. When there is a default on payment obligations such as fees, and the User fails to make correction even after making a notification 4. When the User is insolvent or the User is subject to the suspension of payment, or when the User has filed a petition for the commencement of bankruptcy proceedings, civil rehabilitation proceedings, corporate reorganization proceedings, special liquidation or other similar proceedings 5. When there is no response from the User for 30 days or more after the communication from the Organization 6. When the Organization has determined that the User is antisocial forces etc. (meaning crime syndicate, member of a crime syndicate, right-wing groups, antisocial forces, and other similar entities. The same shall apply hereinafter), or the User is engaged or involved in any way with antisocial forces, such as cooperating or engaging in the maintenance, operation or management of antisocial forces by offering money or other favors 7. In addition, when the Organization determines that the use of the Service is not appropriate 2. The Organization shall not have any responsibility whatsoever for any damage caused to the Users by the actions taken by the Organization based on this article. Article 9 (Deletion of registration of use) The Users may delete the registration of use of the Service by following the prescribed registration deletion procedure. Article 10 (No warranty and disclaimer) 1. The Organization does not guarantee that there are no de facto or legal defects in the information provided through the Service (including defects concerning safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors and bugs, infringement of rights, etc.). 2. The Organization shall have no liability whatsoever for any damages caused to the Users by the Service unless it is due to the Organization's willfulness or gross negligence. Notwithstanding, this disclaimer does not apply if the contract between the Organization and the Users regarding the Service (including the Terms) is a consumer contract as stipulated in the Consumer Contract Act, but even in this case, the Organization shall not assume any responsibility whatsoever for the damage caused to the Users due to special circumstances (includes when the Organization or the Users foresee or can foresee the occurrence of damage.) out of the damage caused to the Users because of default or tort due to the Organization's negligence (excluding intentional or gross negligence). 3. Regarding transactions, communications, disputes, etc. that occur between the User and other users or a third party, the Organization shall not have any liability whatsoever unless it is due to the Organization's intentional or gross negligence. Article 11 (Changes etc. in service contents) The Organization may change the contents of the Service or discontinue its provision at the convenience of the Organization. In the event the Organization ends the provision of the Service, the Organization shall notify the Users or post such notification on the Organization's website in advance. Article 12 (Revision of the Terms of Use) When considered necessary by the Organization, the Organization may revise the Terms by notifying the Users in advance by posting on the website or by any other method that the Organization deems appropriate. By using the Service even after revision of the Terms, the Users will be deemed to have agreed to the revised terms. Article 13 (Use of Google Analytics) The Service uses Google Analytics offered by Google for the purpose of monitoring the status of use of the Service and enhancing its usability. Article 15 (Notification or communication) Notification or communication between the Users and the Organization shall be made by the method specified by the Organization. The Organization will consider that the contact details registered in the Service are valid and use these contact details for making any notification or communication, and the such notification or communication will be deemed to have reached the Users upon dissemination. In addition, the Organization shall not have any liability whatsoever for any disadvantage or damage caused by the User's failure to change the information. Article 16 (No assignment of rights and obligations) Without the prior written consent of the Organization, the Users may neither assign to a third party nor pledge their position under the Terms of Use or their rights and/or obligations under the same. Article 17 (Governing law and jurisdiction) 1. For the interpretation of the Terms, the laws of Japan shall be the governing law. Regarding the Service, the United Nations Convention on Contracts for the International Sale of Goods shall not apply. 2. In the event of a dispute regarding the Service, the court having jurisdiction over the location of the Organization's headquarters shall be the exclusive agreement jurisdictional court. Privacy policy
Privacy Policy (1) Basic premise The Biological Resource Center, National Institute of Technology and Evaluation (NBRC) (hereinafter referred to as the “Organization”) operates the NBRC online catalogue (hereinafter referred to as the “Site”) of the Organization while taking care to protect the privacy of the users of the Site (hereinafter referred to as the “Site Users”). In addition, the personal information provided by Site Users is appropriately managed under the “Act on the Protection of Personal Information Held by Administrative Organs (Act No. 59 of 2003)” and the “Personal Information Protection Management Regulations” of the Organization. (2) Scope of the information to be collected a. The Site automatically collects Internet domain names, IP addresses, web search queries and other information about access to the Site. When the Users wish to request for the Biological Material by using the Site, the Organization asks the Users to provide personal information such as name, telephone number, e-mail address, affiliated institution, and affiliated institution’s address (hereinafter referred to as "Personal Information"). In addition to the above, the Organization may record the request history of the Biological Material and the purpose of the request (hereinafter referred to as the "Request History"). (3) Purpose of collecting information a. The information collected in (2)a. will be used as a reference for the smooth operation of the services provided by the Site. b. The Personal Information collected in (2)b. is used for the following purposes. i. For carrying out the tasks required for the distribution of the Biological Material, such as responding to the inquiries received from the Site Users, invoicing the fees and charges, and shipping the Biological Material. ii. For sending information and questionnaire surveys regarding the services of the organization, seminars, symposiums, training sessions, etc. conducted by the organization provided the prior permission of the Site User is obtained. (4) Limitations on use and provision of the Personal Information collected The Personal Information collected on the Site will not be provided to third parties except in the following cases. a. When there is a request for disclosure under treaties, laws, regulations, ordinances, etc., or when a reporting obligation arises b. When the owner of the Personal Information agrees for the disclosure c. When taking measures under the provisions of laws and regulations d. When the information of the Site User falls under the prohibited matters set forth in the respective clause of Article 6 of the Terms of Use e. When taking measures that are considered indispensable for the preservation of the accumulated information due to the maintenance of the Site and other related facilities f. When it is essential to protect the important interests in terms of public life, health, property, and the like (5) Measures to ensure safety The Organization takes measures necessary to prevent the leakage, loss or destruction of the collected information, prevent unauthorized access, and to appropriately manage the collected information. (6) Revision and suspension of use of the Personal Information The Site User can log in to the Site and revise the Personal Information entered by the Site Users on the account registration screen. If there is an inquiry from the Site User regarding the correction or suspension of use of the Personal Information, the Organization will promptly respond to it within a reasonable scope after verifying the identity of the person. (7) Scope of application “Privacy Policy” given here applies to the Site only. (8) Revision of “Privacy Policy” ” Privacy Policy” may be revised without any notice. When any revision is made, it will be posted on the Site.
